Terms of Service

This is a general template Terms of Service prepared for the AsiaWell website. It should be reviewed by qualified legal counsel before publishing, to ensure it reflects AsiaWell's actual operating structure and complies with applicable telemedicine and consumer-protection regulations in India, including the Telemedicine Practice Guidelines, 2020.

1. Acceptance of Terms

By accessing or using the AsiaWell website or platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use AsiaWell.

2. Nature of the Service

AsiaWell is an AI-native telehealth platform that connects patients with independent, licensed doctors for video consultations. AsiaWell facilitates these connections but does not itself practice medicine. AsiaWell is not an emergency service. In a medical emergency, call your local emergency number or go to the nearest emergency room immediately.

3. AI-Assisted Tools

AsiaWell uses generative AI (Gen AI) tools to support symptom intake, doctor-matching, analysis of lab reports and scans you upload, and the drafting of consultation notes and prescriptions. These tools support, but do not replace, the independent medical judgment of your doctor. All AI-drafted or AI-flagged clinical content, including prescriptions and report summaries, is reviewed and approved by your doctor before it is provided to you or relied on in your care. AI outputs may occasionally be inaccurate or incomplete; always rely on your doctor's guidance rather than any AI-generated content alone.

4. Eligibility

You must provide accurate, current information when creating an account. Consultations for minors must be conducted with a parent or legal guardian present.

5. Doctor Independence

Doctors on AsiaWell are independent, licensed medical professionals solely responsible for the medical advice, diagnosis and treatment they provide. AsiaWell verifies doctor credentials before onboarding but does not itself provide medical advice. AI-assisted tools used on the platform do not replace a doctor's independent clinical judgment.

6. User Responsibilities

Provide accurate medical history and symptom information during consultations.
Use the platform only for lawful purposes.
Keep your account credentials confidential.

7. Payments & Refunds

Consultation fees are shown before booking and charged through our payment partners. Refund eligibility depends on the circumstances of the booking (for example, doctor unavailability) and will be handled in line with our support process. Contact support@asiawell.in for assistance.

8. Limitation of Liability

To the extent permitted by law, AsiaWell is not liable for the medical advice, diagnosis or treatment provided by independent doctors on the platform, nor for AI-assisted outputs that have been reviewed and approved by a treating doctor, nor for any indirect or consequential loss arising from use of the platform.

9. Governing Law

These Terms are governed by the laws of India, and courts in Delhi shall have exclusive jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of AsiaWell after changes take effect constitutes acceptance of the revised Terms.
